# The 30 June AFSL Lodgement Moved to 30 September. This Is the Final Window.

ASIC's no action position has two conditions. The business had to be operating in Australia on or before 31 December 2025, and it has to lodge a complete AFSL application in time. The lodgement date was 30 June 2026 until 25 June 2026, when ASIC extended it to 30 September 2026, clarified who the position covers and described the new date as the final call. ## What the Extension Actually Did

The no action position is a bridge. It lets an existing business keep operating while its licence application is assessed, instead of choosing between stopping and operating exposed. The 25 June 2026 extension did three things: it moved the lodgement date to 30 September 2026, it confirmed the position covers businesses operating under or entering authorised representative or intermediary authorisation arrangements with an AFS licensee, and it required firms that need an Australian Market Licence or a clearing and settlement facility licence to notify ASIC in writing and hold a pre-application meeting by the same date.

What the extension did not do is change the consequence of missing it. If your business deals in crypto assets that are financial products, conducting that business without a licence is unlicensed conduct, and once the window closes the bridge that would have covered you while you fixed it is gone. That sentence contains the word that matters: if. Whether a token is a financial product turns on the rights it carries, not the label it wears. Some businesses have serious exposure. Others have less than they fear, because their actual activities sit differently against the law than they assumed. Nobody knows which group they are in until the analysis is done on their specific tokens, services and customers.

## The Clock That Is Still Running

The Corporations Amendment (Digital Assets Framework) Act 2026 (Cth) received royal assent on 8 April 2026 and commences on 9 April 2027. It creates two regulated categories, digital asset platforms and tokenised custody platforms, requiring an Australian financial services licence, with obligations covering safeguarding client assets, disclosure, misleading conduct and dispute resolution. There is an exemption for smaller platforms holding less than 5,000 dollars per customer and facilitating under 10 million dollars in annual transactions, and whether it genuinely covers you deserves more scrutiny than a skim of the thresholds.

The point of raising the commencement date here is simple. A business weighing the September window is not facing an open ended problem. It is facing a dated one. Every path forward has to work not just for today's exposure but for a framework that switches on at a fixed point, and paths that look adequate for one horizon fail on the other.

## The Worst Option Is the Default One

The most common response to a closing regulatory window is a quiet decision to keep operating as before and hope the question never gets asked. It feels like the low risk option because it involves no visible change. It is actually the high risk option, because it converts a fixable position into a longer period of exposed conduct, and the passage of time is not neutral in how that reads later. ASIC has already extended once. Planning around a second extension is not a strategy.

The opposite reaction, shutting everything down, is sometimes right and sometimes an overcorrection that destroys value the law did not require you to destroy. Between those poles sit the real options: lodging inside the window, restructuring under an authorised representative or intermediary authorisation arrangement now that the position expressly covers them, narrowing the business so the licence question changes or preparing a defensible exit. They are different for a custodial exchange, a token project, a brokerage style service and a platform with a genuinely arguable exemption position. What they have in common is that each depends on facts: what you do, what rights your tokens carry, who your customers are and what your operating history looks like.

## What To Do Before 30 September

Three things, in order. Establish whether your tokens and services actually involve financial products, because everything else depends on that answer. Decide the vehicle: your own AFSL application, a variation or an authorised representative or intermediary authorisation arrangement, each of which has to be in place or lodged in time to count. And if a market or clearing and settlement licence is in play, get the written notification and pre-application meeting done, because those steps have the same deadline and less flexibility. All three are analysis first and paperwork second, and all three get harder as the window shortens.
